Code Of Ethics

NO MEMBERS CAN BUY THEIR WAY ONTO ReferralList.com NOR CAN THEY REMAIN MEMBERS UNLESS THEY ADHERE TO THE FOLLOWING STANDARDS:

1. Excellent Customer Service
2. All work performed will meet or exceed standards of the industry.
3. Full disclosure of all risks and costs associated with their service (to the best of their knowledge).
4. All terms and conditions fully specified in writing and adhered to (unless beyond their control).
5. All changes, deviations and amendments to original contract must be in writing and accepted by customer.
6. No advance payments required except under the following conditions:

  • Reasonable fees for estimates and so-called “trip charges”
  • Retainers required by attorneys
  • Deposits for health care and medical procedures
  • An escrow account set up for payment of services
  • A major credit card used for payment (credit cards can be reversed within 60 days if problems arise)
  • Materials are ordered in the name of the customer and payment is applied to order
  • Materials are delivered
  • Work has started
  • Consumers and contractors come to their own private agreements to meet their particular needs and feel completely comfortable with the arrangement

7. Any unsettled dispute shall be reported to Tom Martino and/or his staff and Members agree to abide by Tom Martino 's decision to settle the dispute.


AUTOMOBILE DEALER GUIDELINES

1. Consumers shall be given all information (known by the dealer at the time of inquiry) about the automobile being considered for purchase. This information shall include:

  • The manner of acquisition (e.g. trade-in, auction, etc.)
  • Any known damage (major or minor)
  • Any outstanding recalls or service bulletins not yet performed on vehicle.
  • The existence or non-existence of any warranties (factory or otherwise)
  • On new cars: the total cost of dealer acquisition as defined by factory invoice plus advertising and transportation charges, delivery and carrying costs.
  • On used cars the disclosure of acquisition costs is not required because it does not necessarily reflect true retail value. Dealers often take in used cars on trade and give an "over allowance" to sell another car. That can make a used car appear to be more valuable than it really is. On the other hand, the dealer may buy several cars at a wholesale auction for very low prices. Again, the perceived value would be skewed.

2. Dealer may deliver car before final approval of financing, however dealer agrees not to charge customer for use of the car if it must be returned due to rejection of financing or if financing is not at the terms or conditions originally agreed upon. THIS DOES NOT APPLY IF CONSUMERS MISREPRESENT THEMSELVES IN ANY WAY ON A LOAN APPLICATION.

3. Dealer shall allow consumers to have used cars checked out by a mechanic (of consumer's choice) before they make a final decision on buying the car.

4. Dealer shall not knowingly misrepresent a car in any way.

5. Dealer agrees to rescind any car deal and return all monies to consumer, if Tom Martino finds (in his sole opinion) that the consumer has been cheated in any way, shape or form. This shall apply only if the consumer reports a dispute within 30 days of taking delivery of the car and has not put more than 1,500 miles on the car.

6. If, in the opinion of Tom Martino, complaints generated by a dealer are substantial and/or excessive, Martino may remove Dealer from ReferralList.com immediately and without notice.
